Czech Republic's 'Trumpist' Prime Minister-Elect Refuses to Sell Corporate Holdings Amid Ethical Row

Andrej Babiš, the self-proclaimed tycoon that secured victory in the recent Czech election, has refused to sell his vast corporate assets, while insisting he will address a conflict of interest that could prevent him from assuming the role of prime minister.

Position on Corporate Empire

Babiš, whose political movement came first in the autumn election but did not secure a majority in parliament, declared in a online statement that he would not divest his Agrofert conglomerate, which operates in farming, food processing, and chemicals.

“I have consistently stated I will not sell Agrofert. I have repeatedly stated I will address the ethical issue in compliance with Czech and EU regulations,” Babiš remarked. “This is different from selling a pastry in a bakeshop.”

Head of State's Requirement

The head of state, Petr Pavel, stated that the 71-year-old populist must clarify openly how he will eliminate ethical conflicts arising from his corporate dealings before assuming the role of prime minister.

The national charter “explicitly requires the president to consider the possible emergence of a conflict of interest and the possibilities for its resolution” when appointing cabinet members, Pavel's office explained.

The head of state “expects clarity in what precise manner Andrej Babiš will fulfil his statutory duties”, the announcement added, noting that Pavel was prepared to appoint Babiš as prime minister “immediately” once the matter was resolved.

Business Operations and Regulatory Concerns

Babiš's several hundred firms, mostly under the Agrofert umbrella, operate in the nation and other regional states, benefiting from substantial funds in national and EU farming and other subsidies, as well as public contracts.

Under Czech law, government ministers cannot obtaining state support or agreements. The anti-corruption organization Transparency International has indicated that to prevent a conflict of interest, Babiš must either sell, decline government deals, or not enter government.

Previous Tenure and Present Intentions

Babiš said he would “abide by the regulations” if appointed as premier, but did not want to explain how in beforehand because the issue was “an highly personal and private affair for me, and the media will invariably question me anyway”.

During his initial tenure as premier, from 2017 to 2021, Babiš encountered multiple legal battles and an EU investigation over potential conflicts of interest. He placed his assets into trust funds, while retaining certain control over them.

A judicial body and the EU executive both determined that this did not suffice. Babiš stated recently that he was once more the exclusive proprietor of Agrofert and maintained he was “taking steps” to prevent a ethical problem, but declined to disclose details.

Coalition Deal and Foreign Policy Implications

The wealthy politician has signed a coalition agreement with two minor right-leaning groups, the ultra-conservative, Russia-friendly SPD, which has advocated a public vote on leaving the EU, and the Motorists for Themselves, which has primarily opposed the EU’s environmental policy.

The incoming administration, if approved, is likely to strengthen the populist bloc in the region and could strain backing from Western nations for Ukraine – even though Babiš has contacted Ukraine’s leader, Volodymyr Zelenskyy, to confirm of Czech support.

Pavel, who as president has a role for foreign policy, also demanded that the government agenda include a declaration on the government’s position on Russia’s war in Ukraine, with a pledge to fulfilling Nato obligations.

The president has earlier stated he would not endorse any cabinet candidates who might doubt the nation's international alliances, a requirement that the ultra-conservative party has indicated it will satisfy by nominating non-partisan experts.
